Bower Collective – Terms of Use for Customer-Generated Content, Including Reviews and Images, via Affiliate partnership

These Terms of Use govern your conduct and Bower Collective’s rights associated with the Customer Ratings and Reviews, Customer-Generated Content, and Question and Answer services offered by Bower Collective (the "CRR Service"). These Terms are in addition to Bower Collective’s Privacy Policy. In the event of a conflict between the Privacy Policy and these Terms, these Terms shall take precedence with respect to the CRR Service.

1. Your Representations and Warranties

By submitting any content to Bower Collective, you confirm that:

  • You are the sole author and owner of the intellectual property associated with your content.
  • Any moral rights you may hold in your content have been voluntarily waived.
  • You are at least 18 years old.
  • Your content complies with these Terms and does not cause harm to any person or Organisation.

2. Prohibited Content

You agree not to submit any content that:

  • Is known to be false, inaccurate, or misleading.
  • Infringes the copyright, trademark, patent, trade secret, publicity, or privacy rights of others.
  • Violates any law, statute, regulation, or ordinance.
  • Is or may reasonably be considered defamatory, hateful, harassing, threatening, offensive, or otherwise inappropriate.
  • Has been compensated, gifted, or incentivised by a third party.
  • Contains references to external websites, contact details, or promotional content.
  • Includes any viruses, malware, or harmful files or links.

3. License and Use of Submitted Content

By submitting content, you grant Bower Collective a:

  • Perpetual, irrevocable, royalty-free, transferable license
  • To use, copy, modify, delete, adapt, publish, translate
  • Create derivative works, sell, distribute, or incorporate your content into any format, in any medium, globally and without compensation to you.

Bower Collective reserves the right, at its sole discretion, to:

  • Edit, shorten, or remove content that violates these Terms or is otherwise deemed inappropriate.
  • Reject or remove content from publication without prior notice.
  • Decline to offer an option for editing or deleting content once submitted.

You acknowledge that:

  • Content is typically reviewed and posted within 2 to 4 business days.
  • You are entirely responsible for your submission.
  • Bower Collective is not obligated to treat your content as confidential.

4. Indemnity

You agree to indemnify and hold harmless Bower Collective and its directors, employees, partners, subsidiaries, affiliates, and third-party service providers from and against all claims, damages, costs, and expenses (including reasonable legal fees) arising from:

  • A breach of your warranties or representations.
  • Your violation of any applicable laws or the rights of a third party.

5. Social Media Content Permissions

If you respond with “Yes” or “Agree” to a request by Bower Collective on social media, you grant the following permissions regarding your media content (the "Content"):

  • Permission for use of your photograph, video, caption, or other media submitted via social media.
  • A royalty-free, irrevocable, perpetual license to use the Content in any advertising or promotional campaign, including:
    • Website and online platforms
    • Social media and email campaigns
    • Printed publications, packaging, or display advertising
    • Digital and TV advertisements
  • You authorise Bower Collective to share the Content with third-party partners and service providers for marketing use.
  • If the Content includes children, you confirm that:
    • You are the parent or legal guardian, or
    • You have obtained permission from the parent or legal guardian of each child shown.
